Terms and conditions.

1. Entrepreneur

For the business relations between keepers knitwear (hereinafter referred to as "Seller" or “keepers knitwear”) and the purchaser (hereafter referred to as ‘client’ or ‘customer’).

keepers knitwear uses squarespace.com services for its e-commerce publishing.

2. Principles of functioning of the keepers knitwear online shop

keepers knitwear sells goods via its online shop.

The customer accepts these General Terms and Conditions by purchasing goods on on this website.

3. Ordering goods

3.1. Orders are placed via the website www.keepers-knitwear.com The minimum age for shopping at www.keepers-knitwear.com is 18 years old for all payment methods.

3.2. Goods in the online shop have detailed descriptions. On the website, there is information concerning the properties of products, their prices, materials of which they are made, etc.

3.3. The client orders goods in a manner appropriate for a given article, defining, in particular, its size and colour and, if needed, providing other detailed information and the number of pieces ordered.

4. How to shop in the online store – detailed instructions

The order process consists of the following steps:

4.1. The customer places the selected product from the offered assortment by clicking the button "add to bag" without obligation into the virtual shopping cart.

4.2. All items that have been placed in the shopping cart can be viewed by clicking on the "shopping cart", which is visible in the upper part of the website. Here you can also delete items or change the number of products that you want to buy.

4.3. If the items are to be bought from the shopping cart, please click on the "checkout" button.

4.4. The following payment methods are available to the customer: 

  • Credit card (VISA/Mastercard)

  • Paypal

  • If you are not in possession of a creditcard, but you would still like to order an item of keepers knitwear, you can contact me by mail (keepers.knitwear@gmail.com), and we can arrange a payment by bank transfer.

4.5.    After selecting the payment method, the customer determines the delivery details and the delivery address. After selecting the delivery method, the customer can buy additional products or have the order overview displayed.

4.6. By clicking the "Buy" button, the customer makes a binding request for the purchase of the goods in the shopping basket.

4.7. If the customer wants to change her/his order, she/he has chance only before clicking the „Buy” button.

4.8. keepers knitwear operates a ‘zero stock’ policy. Thus, all items are made to order. Upon reception of the order, the item(s) will be produced in the keepers knitwear atelier. While keepers knitwear guarantees the fastest possible production, it can take up to two weeks before the item(s) is/are shipped. This delivery estimation is approximative and can vary depending on the amount of orders.

4.9. The seller may contact the customer by telephone (as long as a telephone number has been provided by the customer) or by e-mail in order to clarify any outstanding questions regarding the order and delivery. The use of the telephone number and the e-mail is exclusively for the purpose of handling the order and the delivery and is not expressly used for advertising purposes, unless there is an explicit consent of the customer.

5. Prices

Prices on the website are stated in EURO/ given currency and are gross prices (they include VAT tax). The shipping costs are added to the price of a given product. Please consult the section shipping costs for more information.

The price stated on the website at the moment of the placement of the order is final and binding for the customer. The price of goods ordered will not change after an order for them has been placed, regardless of changes concerning prices introduced by keepers knitwear and regardless of any promotional activities or clearance sales.

keepers knitwear reserves the right to change the prices of goods in its online shop, make new goods available for purchase, carry out and cancel promotional activities on the website of the shop, or introduce changes to promotional activities in line with the provisions of the civil code and other acts.

6. Availability of goods ordered

All goods sold in the online shop are made to order. Products may occasionally prove unavailable under special circumstances (e.g. when multiple customers order the same product simultaneously and there is not enough yarn available to cover all orders). If this is the case, the customer will be informed. On the product view, customers can find information about the size range and colours available. If you have any special inquiries regarding a product (e.g. if you want to order an item in a specific size which is not indicated on the webshop), you can always send an email to keepers.knitwear@gmail.com, so we can figure out a solution for your special request.

7. Incomplete order performance

If it is impossible to perform an order for whatever reasons, the customer shall be notified via e-mail of the problems concerning the performance of her/his order, and of possible solutions (e.g. partial order performance, full performance but at a later date, or cancelling the order in its entirety without negative consequences for the Client). If partial order cannot be executed, the order will be cancelled without negative consequences for the Client; if the Client has already paid for the order, the amounts she/he paid will be returned to her/him.

8. Order reception and order performance time

The order which is paid for on its receipt is immediately accepted for performance.

In case of online payment, orders shall be accepted for performance after it is confirmed that money has been credited to the keepers knitwear account (via creditcard). The product(s) will be manufactured and sent to the customer by bpost within 2 weeks. 

If another payment method has been arranged (e.g. bank transfer), the performance of the order shall commence after 100% of the amount due for a given order has been transferred to the account of the online shop (or of intermediary entities).

9. Shipping

  • Shipping to Belgium: Ordered goods shall be delivered by bpost within an average estimated delivery time of one business day, following the day the parcel was sent.

  • Shipping to other EU countries: Ordered goods shall be delivered via bpost within an average estimated delivery time of 3 business days, following the day the parcel was sent. 

Shipping times are subject to the legislation of bpost.

keepers knitwear does not take responsibility for any delays caused by the courier service.

11.   Right to cancel – withdrawal from the agreement

You have the right to cancel this contract within 14 days without giving any reason. The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good. To exercise the right to cancel, you must inform keepers knitwear by email (keepers.knitwear@gmail.com). The items can only be sent back in original condition, in unsealed packaging without any qualitative or quantitative defect.  To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

12.  Effects of cancellation

If you cancel this contract, we will reimburse to you all payments received from you. We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.

We will make the reimbursement without undue delay, and not later than:

  • 14 days after the day we receive back from you any goods supplied, or

  • (if earlier) 14 days after the day you provide evidence that you have returned the goods, or

  • if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

13. Complaints

Every article purchased from the keepers knitwear online shop (www.keepers-knitwear.com) can be the subject matter of a complaint provided that the deadlines and terms and conditions concerning complaints are observed and provided that the article is defective in such manner as to be inconsistent with the agreement concluded. Complaints can be sent by mail. For complaints sent by mail, the customer needs to indicate the underlying causes of the complaint and provide information necessary to identify the relevant order. If a complaint sent via mail is considered valid, keepers knitwear shall send a defect-free (i.e. fixed or new) product within 14 days or, if this should prove impossible, reimburse the purchase price in its entirety.

If a complaint is not considered valid, the product shall be sent back to the client together with an opinion explaining why the complaint was not acknowledged.

14. Order cancellation

The Client has the right to cancel her/his order within fifteen minutes after placing the order. The Client can exercise this right by contacting Customer Service using the contact form available on the website.

15. Final provisions

The relevant receipt or invoice shall be enclosed to every product purchased. keepers knitwear shall not be responsible for the customer providing erroneous data.

15.1. Personal data processing

The Client gives keepers knitwear a clear and informed consent for processing his/her personal data.  The personal data (as understood by Data Protection Act) will be used for providing sales service and offering products to the customer.

The customer’s consent to keepers knitwear processing his/her personal data is voluntary but without the consent, it will be impossible to perform the agreement and orders.

The personal data will be processed by keepers knitwear

The personal data necessary for delivery will be forwarded to a business providing transport and delivery services. It may also be necessary to transfer your personal data to third parties who provide us with support services, such as financial bodies and entities that fight against fraud.

15.2. Personal data processing for marketing purposes

The customer can consent to her/his personal data (as understood by Data Protection Act) being processed for marketing purposes according to Privacy Policy by keepers knitwear.

15.3. Personal Data Administrator

Personal data administrator will be keepers knitwear.

In line with the provisions of the Data Protection Act, the Client provides her/his personal data voluntarily and has the right to access her/his data and correct them or change or to request that such data be deleted.

16. Competence and applicable law

All agreements concluded with the Company are governed by Belgian Law, to the exclusion of the provisions of the United Nations Convention on the International Sale of Products. The Company and the Buyer (“the Parties”) agree to use all reasonable efforts to reach a fair settlement of any disputes relating to their agreements. In the event of any dispute, difference, controversy or claim arising out of in connection with to their agreements, the parties will first attempt to settle such dispute amicably. If the parties cannot agree on the resolution of any dispute, they agree to appoint a qualified neutral third party with expertise in the area of concern (hereinafter “Mediator”). Such Mediator shall be consulted to mediate and make recommendations as to the resolution of the matter in a timely manner. The costs of such mediation shall be divided equally between the Parties. 

If the Parties have not reached a settlement of such dispute, the dispute shall finally be settled by arbitration in accordance with the Rules of Arbitration of Cepani (Centre Belge d’Arbitrage et de Mediation – Belgian Center for Arbitration and Mediation) as presently in force. The place of arbitration shall be Brussels and the language to be used in the arbitral procedure shall be French.

The Parties agree to call upon the services of the Belgian Center for Mediation and Arbitration for both mediation or arbitration (www.cepani.be). If Cepani’s decision is not satisfactory to one of the Parties, they still can submit their disputes to the Courts, provided that these disputes shall be submitted to the exclusive jurisdiction of the Courts of Brussels.
